The Ninth Circuit slapdown is welcome. Even better would be one from the Supreme Court, which is now deprived of the opportunity to repudiate the notion that Bush v. Gray Davis. Lawyers for the American Civil Liberties Union, who had challenged the election date, said they would not pursue the matter further.
