Here’s the opinion of the en banc panel allowing the Oct. 7th election to go forward in California. Based on yesterday’s oral arguments, they didn’t have to sweat on this one at all. Simply put, the ACLU had no case, and as good a lawyer as that Laurence Tribe character may be, he couldn’t pull a rabbit out of thin air.

Issa is now afraid the recall won’t do what he wanted it to. Democracy in action, I guess.
He’s playing chicken with McClintock, because he doesn’t know that he’s the kinda guy who digs his heels in harder the harder he’s pushed. Issa’s basically an amateur politician with a great talent for selling car alarms but not much knowledge of the system.
